By accessing or using Homar ("the Service"), operated by Homar.io ("we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you must not access or use the Service. We reserve the right to update or modify these Terms at any time by posting the revised version on this page with a new "Last updated" date. Your continued use of the Service after any such changes constitutes your acceptance of the updated Terms. We encourage you to review these Terms periodically.
Homar provides cloud infrastructure for deploying AI-powered chatbots on messaging platforms such as Telegram and WhatsApp. The Service enables you to:
We may add, modify, or discontinue features of the Service at our discretion. We will make reasonable efforts to notify users of significant changes.
We may offer free AI credits (up to $15 value) to new users at our sole discretion. Free credits are non-transferable, have no cash value, cannot be combined with other offers, and may be withdrawn, modified, or expired at any time without notice. Credits are limited to one allocation per user and per account. Any attempt to abuse or exploit the free credits system (including creating multiple accounts) may result in immediate account termination.
You agree not to use the Service to:
We reserve the right to investigate suspected violations and to suspend or terminate accounts found in violation of these Terms, at our sole discretion and without prior notice. We may also report illegal activities to the relevant authorities.
You retain full ownership of your bot credentials, configurations, and any content your bot sends or generates. By providing bot tokens to Homar, you grant us a limited, non-exclusive, revocable licence to use those credentials solely to operate and maintain your deployment on our infrastructure.
You are solely responsible for the content your bot produces, the conversations it engages in, and any consequences arising from its deployment. This includes ensuring that your bot's responses comply with applicable laws and the terms of any third-party AI provider you use.
The Service, including its design, code, features, branding, logos, and documentation, is owned by Homar and protected by intellectual property laws. Nothing in these Terms grants you any right, title, or interest in the Service except for the limited right to use it in accordance with these Terms.
You may not copy, modify, distribute, sell, or lease any part of the Service, nor may you use our trademarks, logos, or branding without our prior written permission.
We strive to maintain high availability of the Service but do not guarantee uninterrupted, error-free, or secure access at all times. The Service may be temporarily unavailable due to scheduled maintenance, unscheduled outages, infrastructure issues, or events beyond our reasonable control. We are not liable for any loss or damage arising from downtime caused by maintenance, third-party service outages (including but not limited to Telegram, WhatsApp, Anthropic, and cloud hosting providers), network failures, or force majeure events.
To the maximum extent permitted by applicable law, Homar, its founders, team members, affiliates, and contractors shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to loss of profits, data, goodwill, business opportunities, or revenue, arising out of or related to your use of or inability to use the Service, regardless of the theory of liability.
Our total aggregate liability to you for any and all claims arising from or related to the Service shall not exceed the total amount you have paid to us in the three (3) months immediately preceding the event giving rise to such claim, or fifty euros (€50), whichever is greater.
The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will meet your specific requirements, that any AI-generated content will be accurate, complete, or suitable for your purposes, or that the Service will operate without interruption or errors.
You agree to indemnify, defend, and hold harmless Homar and its team members, affiliates, and contractors from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) content generated by your bot; (d) your violation of any third-party rights; or (e) any misuse of your account.
Either party may terminate these Terms at any time. You may terminate by cancelling your subscription and deleting your account through the dashboard, or by contacting us at info@homar.io.
We may suspend or terminate your access to the Service immediately, without prior notice or liability, if we reasonably believe that you have violated these Terms, engaged in fraudulent or illegal activity, or posed a risk to the security or integrity of the Service or other users.
Upon termination, your right to use the Service ceases immediately, your cloud deployment will be decommissioned, and your bot credentials will be removed from our systems. Sections covering limitation of liability, disclaimer of warranties, indemnification, intellectual property, and governing law shall survive termination.
We reserve the right to modify, suspend, or discontinue any part of the Service (including features, pricing plans, or integrations) at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.
We shall not be liable for any failure or delay in performing our obligations under these Terms if such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, war, terrorism, pandemics, government actions, power outages, internet or telecommunications failures, or third-party service disruptions.
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Homar regarding the use of the Service and supersede all prior agreements, representations, and understandings, whether written or oral.
These Terms are governed by and construed in accordance with the laws of the jurisdiction in which Homar is incorporated, without regard to conflict of law principles.
Any disputes arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If a resolution cannot be reached within 30 days, either party may pursue binding arbitration or bring a claim in the competent courts of the applicable jurisdiction.
