Terms of Service

1. Acceptance of Terms

By accessing or using Homar ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. We may update these terms at any time; continued use constitutes acceptance of the updated terms.

2. Description of Service

Homar provides cloud infrastructure for deploying AI-powered chatbots on messaging platforms such as Telegram. The Service enables you to connect your bot credentials, pair with your Telegram account, and power your bot with an AI model via subscription or provided credits.

3. Accounts

• You are responsible for maintaining the security of your account credentials.
• You must be at least 18 years old to use the Service.
• One account may have one active bot deployment at a time.
• You are responsible for all activity that occurs under your account.

4. Subscriptions & Billing

• Subscriptions are billed monthly and renew automatically until cancelled.
• Payment is processed by Stripe. By subscribing, you agree to Stripe's Terms of Service.
• You may cancel at any time. Cancellation takes effect at the end of the current billing period — no partial refunds are issued.
• We reserve the right to change pricing with 30 days' notice. Continued use after price changes constitutes acceptance.
• Cloud server reservations expire after 60 minutes if not activated. Reserved capacity is released back to the pool automatically.

5. Acceptable Use

You agree not to use the Service to:

• Send spam, unsolicited messages, or engage in phishing or fraud.
• Violate any applicable laws or regulations.
• Distribute malware, viruses, or harmful code.
• Harass, abuse, or harm other users or third parties.
• Impersonate individuals or organisations.
• Violate Telegram's Terms of Service or Bot API policies.
• Attempt to reverse-engineer, hack, or disrupt the Service or its infrastructure.

We reserve the right to suspend or terminate accounts found in violation of these terms without notice.

6. Your Content & Credentials

You retain ownership of your bot credentials and any content your bot sends. By providing bot tokens to Homar, you grant us permission to use them solely to operate your deployment. You are solely responsible for the content your bot produces and any consequences of its deployment.

7. Free Credits

Free AI credits ($15 value) are provided at our discretion, are non-transferable, have no cash value, and may be withdrawn or modified at any time. Credits are limited to one allocation per account.

8. Availability & Uptime

We strive for high availability but do not guarantee uninterrupted service. We are not liable for downtime caused by maintenance, third-party outages (Telegram, Anthropic, cloud providers), or events outside our reasonable control.

9. Limitation of Liability

To the maximum extent permitted by law, Homar and its team shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability to you for any claim shall not exceed the amount you paid us in the three months preceding the claim.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement.

11. Termination

Either party may terminate these terms at any time. Upon termination, your access to the Service will cease and your cloud deployment will be decommissioned. Sections covering liability, disclaimers, and acceptable use survive termination.

12. Governing Law

These terms are governed by the laws of the jurisdiction in which Homar is incorporated, without regard to conflict of law principles.
